These Terms & Conditions constitute a legally binding agreement between the user ("Customer", "you", "your") and First Wave Technology regarding the purchase, use, and servicing of First Wave products and services.
By accessing our website, placing an order, or using any First Wave product, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions in full.
1. DEFINITIONS
- "Products": All computers, custom PCs, components, accessories, peripherals, and bundles sold by First Wave.
- "Custom PC": Any PC configured, selected, modified, or customized by the customer.
- "Website": All online platforms operated by First Wave including but not limited to our official website, landing pages, and ecommerce portals.
- "Marketplace": Amazon, Noon, Flipkart, Shopify stores, or any third-party selling platform.
2. GENERAL DISCLAIMER
All products are sold "as is" and "as available" except where expressly stated under the warranty section. First Wave makes no guarantees that its products or website will be uninterrupted, error-free, or immune to technical issues. To the maximum extent permitted by law, First Wave disclaims:
- All implied warranties
- All liability for damages
- All responsibility for third-party actions
- Any guarantee of suitability for a specific purpose
3. WEBSITE USE & CONTENT
- You agree not to interfere with the operation of the website, servers, or security features.
- All content, images, product descriptions, and documentation are intellectual property of First Wave.
- Unauthorized reproduction, scraping, reverse engineering, distribution, or commercial misuse is strictly prohibited and may result in legal action.
4. PRODUCT SPECIFICATIONS & ACCURACY
- Technical specifications, component brands, and designs may change without notice due to supply-chain requirements or performance enhancements.
- First Wave is not liable for minor discrepancies in color, appearance, material finish, or styling shown in images.
- Equivalent or superior components may be used without customer approval.
5. PRICING, ORDERS & PAYMENT TERMS
- All orders are subject to acceptance and availability.
- Payment must be completed before processing.
- We reserve the right to reject, cancel, or refuse service for any order suspected of fraud, misuse, incorrect pricing, or policy violations.
- In the event of a pricing error, First Wave may cancel the order even after payment, with a full refund issued.
6. SHIPPING, DELIVERY & TRANSFER OF RISK
- Delivery times are estimates and not guaranteed.
- Once the product is handed to the courier, risk passes to the customer, including loss, theft, or damage during transit.
- Claims for short-shipment or physical damage must be reported within 24 hours.
- First Wave is not responsible for customs delays, import duties, or courier failures.
7. WARRANTY TERMS
7.1 Standard Hardware Warranty
- PCs, laptops, and mini PCs: 1-year limited hardware warranty
- Accessories: 6-month limited warranty
This warranty is limited strictly to hardware manufacturing defects.
7.2 Warranty Exclusions
Warranty is void if damage or failure results from:
- Serial numbers or tamper seals are removed or damaged
- Physical damage, drops, dents, liquid spills
- Electrical surges, unstable power, improper installation
- Unauthorized repair attempts or opening sealed components
- Overclocking, BIOS modification, or firmware tampering
- Use for mining, server hosting, 24/7 workloads, or extreme thermal environments
- Software corruption, malware, OS issues, or user installations
- Dust accumulation, rust, humidity, or poor ventilation
- Customer installs components improperly
- Product overheats due to improper cleaning or airflow obstruction
7.3 Data Loss
- First Wave is not liable for loss of data under any circumstances.
- Customer must back up all data prior to service, repair, or replacement.
7.4 Warranty Decisions
- Repair, replacement, or refurbishment is at First Wave's sole discretion.
- Replacement units may be refurbished or equivalent models.
8. CUSTOM PC TERMS
Custom-built PCs are subject to additional legal protections for First Wave.
8.1 Component Substitution
First Wave reserves the right to replace components with equal or superior parts based on availability, without prior notice.
8.2 Non-Refundable Nature
Once a custom order enters the assembly or procurement stage, it cannot be cancelled, refunded, or returned.
8.3 Performance Disclaimer
Actual performance may vary depending on usage, software, drivers, and user modifications. First Wave is not liable for incompatibility with third-party software, peripherals, or specialty tools.
8.4 Modification Clause
Any user modification—including opening the case, replacing parts, or altering settings—may void the warranty.
9. RETURNS, REFUNDS & EXCHANGES
- Standard products may be returned within 7 days, only if unopened, unused, and in original packaging.
- Opened or used products are not eligible for return.
- Custom PCs, software licenses, and digital products are non-refundable under all circumstances.
- Marketplace platform policies may override these terms for orders placed through those platforms.
10. SERVICE PROCEDURE
10.1 Warranty Claim Requirements
Customers must provide:
- Original invoice/order number
- Serial number
- Clear description of the issue
- (If requested) Photos or videos demonstrating the defect
Products must be returned in reasonable packaging to prevent further damage.
10.2 Diagnostic Evaluation
First Wave technicians will test the product to verify the defect. If the issue is not covered under warranty, diagnostic or repair fees may apply.
10.3 Turnaround Time
- Standard repair/diagnostic time: 7–21 working days, subject to part availability.
- First Wave is not responsible for delays caused by suppliers, couriers, customs, or manufacturer approvals.
11. LIMITATION OF LIABILITY
To protect First Wave from legal risk, the following limitations apply:
First Wave is not liable for any indirect, incidental, or consequential damages, including:
- Data loss
- Software corruption
- Loss of business or revenue
- Downtime or inability to use the product
Maximum liability will never exceed the original purchase price. Warranty is non-transferable and applies only to the original purchaser. Warranty does not cover reinstallation of software or system formatting unless paid service is requested.
12. CUSTOMER RESPONSIBILITIES
Customers agree to:
- Maintain safe usage conditions, proper ventilation, and electrical protection
- Use surge protectors or UPS systems
- Handle products carefully
- Back up all important data
- Provide accurate information for service requests
- Comply with local laws and technology standards
13. THIRD-PARTY SOFTWARE & PERIPHERALS
First Wave is not responsible for:
- Third-party driver issues
- Software crashes
- Incompatibility with external hardware
- Licensing issues for customer-installed applications
14. AI, MINING & HIGH-INTENSITY USAGE
Use of First Wave products for the following without written approval voids warranty:
- Crypto mining
- Continuous 24/7 AI workloads
- Industrial machine operations
- Data center environments
- Extreme overclocking or benchmarking loops
15. IP RIGHTS & BRAND PROTECTION
All logos, trade names, product designs, manuals, and marketing assets are the exclusive property of First Wave. Copying, reusing, or misrepresenting our brand is strictly prohibited. Legal action will be taken against unauthorized sellers or counterfeit listings.
16. RESELLERS, DISTRIBUTORS & MARKETPLACE SELLERS
- Unauthorized resale, price manipulation, or listing misuse is prohibited.
- First Wave may terminate seller authorization immediately for violations.
- Product warranties may not apply to unauthorized sellers or grey-market purchases.
17. FORCE MAJEURE
First Wave shall not be liable for delays, failures, or inability to perform due to events beyond reasonable control, including supply-chain disruptions, natural disasters, political events, strikes, or global shortages.
18. SHIPPING & LOGISTICS TERMS
- Customer is responsible for safe packaging of returned items.
- Warranty shipping costs:
- Customer → First Wave: Paid by customer
- First Wave → Customer: Paid by First Wave if the warranty is approved
- If a product is returned and diagnosed as No Fault Found (NFF), customer may be billed for testing and return shipping.
19. DEAD ON ARRIVAL (DOA) POLICY
A product is considered DOA if:
- It fails within 7 days of purchase, and
- The defect is confirmed by First Wave technicians
DOA resolution:
- Replacement with a new unit, OR
- Full repair if the exact model is not available
20. GOVERNING LAW & JURISDICTION
These Terms & Conditions are governed solely by the laws of the United Arab Emirates. All disputes are subject to the exclusive jurisdiction of UAE courts.
21. AMENDMENTS & UPDATES
First Wave reserves the right to update, modify, or revise these Terms & Conditions at any time without prior notice. The updated version becomes effective immediately upon publication.
